Conflict and Settlement of Paer’s Customary Land Tenure in Central Lombok Indonesia

Abstract

Rights of customary land serve as the rights of indigenous communities in Indonesia. The agrarian law itself, in Indonesia, is based on customary law which characterizes the national agrarian law development strategy. However, conflicts on customary land tenure among indigenous people and the government often arise. Related to the thoughts, this paper was written to review the conflict of Paer’s customary land in Central Lombok. Paer as the customary land of Sasak tribe in Central Lombok is on the verge of its extinction. Nowadays, Paer’s rights were controlled by capitalist groups. The control and the expropriation of Paer's land were carried out using colonial rule. The colonial rule itself has a dominion principle, where the land that cannot be proven by the community must be returned to the country. In this principle, there is government determination that conspired with villages, local officials, and indigenous community leaders. It was to control Paer before being pawned to investors and land bandits. This condition triggered vertical and horizontal conflicts among indigenous communities in Central Lombok, Indonesia.
